Membership Agreement

The undersigned Member, being desirous of becoming a member of G Sports Club, LLC agrees as follows:

• PARQ – Member represents and warrants that all facts stated in the Physical Activity Readiness Questionnaire (PARQ) submitted by member are true and correct. The PARQ is incorporated as part of the agreement.

• Payment – All payments to G Sports Club, LLC for membership are final. Member is encouraged to pay the then current membership fee plus applicable taxes each month thereafter though “automatic” withdrawal from an account maintained by member in a financial institution pursuant to an authorization form signed by member or a debit/credit card. Please note that G Sports Club, LLC reserves the right to change membership fees and product prices at their discretion.

• Return Check Fees – Any return checks or declined Auto Bill for insufficient funds shall be accessed a fee of $25.00 for single or $35.00 for family. (Read Auto Bill Policy)

• Membership Access – Member will be issued an access number which will entitle member to enter and enjoy the benefits of the facility. Member agrees not to allow others to access the facility with member’s access number and will not allow anyone to enter along with member. Members are not allowed to let anyone in the facility when the doors are locked. Members may bring in guest during and after staffed hours. All guests are to sign the guest log and pay a guest fee of $5.00. If the gym is unstaffed and the member, when leaving must make sure his or her guest also leaves. Guests during unstaffed hours are not allowed to remain in the gym without member. The member is responsible for their guest.

• Facility Hours of Operation – The facility is accessible to members using the access number seven days a week from the hours of 3 am – 11 pm. All members and guest must be out of the facility by 11:15 pm. G Sports Club, LLC reserves the right to man the facility based on the schedule allowable by management. G Sports Club, LLC also reserves the right to close or shutdown the facility for maintenance management.

• Personal Training– G Sports Club, LLC reserves the right to offer personal training by a certified personal trainer who is not employed by G Sports Club, LLC. The personal trainer must carry their own general liability insurance and provide such current documents as well as paying trainer’s dues to G Sports Club, LLC. Member understands and agrees that any certified personal trainer is not an employee of G Sports Club, LLC and therefore G Sports Club, LLC will not be held liable for any personal training and injuries to member while participating in personal training exercises including injuries caused by members negligence, sudden and unforeseen malfunctioning of any equipment, instruction, training supervision or dietary recommendations. This also includes slipping and or falling while in the facility and on the facilities premises and adjacent sidewalks and parking areas.

• Release and Waiver of Liability – Member recognizes that there are hazards and risks connected with physical fitness training. These risks include, but are not limited to, abnormal blood pressure, fainting, heart disorders and heart attacks, dehydration, heat exhaustion, sprains, muscle strains, blisters, stress fractures, shin splints, tendonitis, cartlilage tears, bursitis, back pain and bruising of the joints. Exercise beyond one’s physical limits and/or accidents involving exercise equipment may result in serious injury or death. Member agrees to defend, indemnity and hold G Sports Club, LLC and it’s management, officers, agents and employees harmless from and against any and all loss, damage and expense incurred by reason of any claim or liability based upon personal injury (including death) or property damage arising out of the negligent or intentional action of member. Member further agrees to release G Sports Club, LLC and it’s management, officers, employees and agents free and harmless from and against the same. Any recommendation for changes in diet including the use of food supplement, weight reduction and/or body building enhancement products are entirely the members responsibility and member should consult a physician prior to undergoing an dietary or food supplement changes. Member agrees that they are voluntarily participating in these activities and use of the facility and premises and that all members ASSUMES ALL RISKS of injury, illness or death. Additionally, member acknowledges that surveillance cameras are in use for the protection of the facility and its equipment. Member gives it consent to be photographed and/or recorded.

• Rules and Regulations – Member acknowledges that G Sports Club, LLC operates under rules and regulations established for the safety and protection of patrons and agrees to be bound by them as well as by rules and regulations subsequently approved and posted or published by G Sports Club, LLC. Rules and regulations, in effect from time to time, are incorporated into this Agreement by reference. Facilities, equipment, hours, service, regulation and policies are subject to change without prior notice, at the sole discretion of G Sports Club, LLC and member agrees to accept such reasonable change as a condition of membership. Member additionally recognizes:

1. Under no circumstances shall a member move exercise equipment or use the equipment in any manner not authorized by G Sports Club, LLC.

2. All equipment shall be wiped down by member with the supplies provided after each use.

3. The membership is only for member only and member will not give access to another individual or misuse the equipment.

4. Members are to conduct themselves in a quiet, well-mannered fashion so as not to cause any disturbance, which may interfere with the use of enjoyment of the facility by others. Profane or indecent language and/or behavior are not allowed. Any conduct deemed by G Sports Club, LLC in its sole discretion to be offensive, potentially harmful, dangerous and/or abusive will not be tolerated.

5. Any members under the age of eighteen years requires a signed parental authorization form. Children under the age of fourteen are not permitted in any workout areas including the racquetball court. NO CHILD UNDER THE AGE OF FOURTEEN IS ALLOWED ON THE MEZZAINE. This could result in termination of member’s membership.

6. G Sports Club, LLC is not responsible for lost or stolen items on entire property, including inside facility, outside facility and vehicles of members.

7. Members should not occupy a weight station for an extended period of time. Member should allow those waiting for machines to work into their rotation.

8. The climate of the facility is controlled by G Sports Club, LLC and is set to provide the optimum exercise environment for the majority of the members. Member shall not change or seek to change any environmental controls including fans and shall never prop open any facility door for any purpose.

9. All members agree that they are not permitted behind the customer service counter for any reason.

10. Keep hands and feet away from all moving parts and weight stacks. Do not attempt to repair or adjust any equipment that has malfunctioned. Report any equipment issues to the staff.

11. Always use a spotter when attempting maximum weight. Collars and clips are available for ‘free bar’ lifting at the discretion of the member.

• Prohibited Items and Activities – NO alcohol, drugs or tobacco of any type allowed. You cannot use the facilities or engage in any activity at G Sports Club, LLC while under the influence of drugs, alcohol or medication that may impair the ability to operate equipment. Also, G Sports Club, LLC does not permit tobacco of any kind, alcohol, illegal drugs in the facility or on the property. No weapons of any kind are permitted in G Sports Club, LLC or on its property. No photography, videotaping, filming or audio recording is permitted without written permission of the management of G Sports Club, LLC. G Sports Club, LLC reserves the right in its sole discretion, to limit the consumption of food or beverages in workout area. G Sports Club, LLC reserves the right , in its sole discretion, to limit or restrict the use of outside equipment in the facility or on the premises. Gambling or gaming is prohibited in the facility or on the premise.

• Dress/Towel Policy – G Sports Club, LLC requires you to wear appropriate clothing and footwear while in the facility. General guideline: gym shorts, workout pants, t-shirts, tank tops and jogging, or aerobic or tennis shoes. No street clothing or street shoes will be allowed on the gym floor or on cardio equipment. All males must keep their shirts on at all times.

• Lockers – We provide day lockers that are available by the front door. Make sure you remove all items from the locker when leaving. We also provide lockers in the locker room. These lockers may be rented for $10.00 per month. You may also use the locker while you’re working out but must remove your property from the locker if you haven’t rented one. All unrented lockers with locks will be cut and property removed the the locker. G Sports Club, LLC will not be responsible for the property removed from the lockers.

• Entire Agreement – This agreement, and all documents mentioned hereto by reference, constitutes the entire agreement between member and G Sports Club, LLC. It cannot be amended unless by mutual consent in writing by the parties. This agreement may not be cancelled except as provided for herein.

• Suspension and Termination – I understand that G Sports Club, LLC may suspend or terminate any membership without any refund for failure to adhere to the terms of this agreement or for violation of the facility’s policies and procedures.

• Cancellation by Member – If a member is on Auto Bill, the member must come in and fill out an Auto Bill Cancellation form. The member must give G Sports Club, LLC a 31 day cancellation notice. Failure to do so will result in a re-instatement fee if member ever returns.

• Acceptance of Terms – As a member, I understand that I am entitled to use the facilities, within the scope of the membership that I have selected and that I am obligated to pay my dues and fees regardless of whether I use the facilities. As the primary member or card holder I understand that I am responsible for any additional family members on the account and will make sure that they are aware of the rules and regulations of G Sports Club, LLC. I agree to promptly update G Sports Club, LLC of any changes of address, phone and credit information that may directly affect my membership agreement with G Sports Club, LLC.
